GENERAL CONDITIONS OF ONLINE SALE

These contractual conditions apply exclusively between the company CHOOSE WOOD S.R.L., P.I. 09793980963, with registered office in Via D’Adda 4/4, 20019 Settimo Milanese (MI) on the one hand (hereinafter referred to as “Choose Wood”) and, on the other hand, any natural person who purchases online on the website www. choosewood.it (hereinafter referred to as “Customer”). These conditions may be subject to changes without notice, with effect from the date of publication of the same on the website www.choosewood.it.
These conditions govern purchases made on the website www. choosewood.it, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code (Legislative Decree no. 206/2005), amended by Legislative Decree no. 21/2014 and by Legislative Decree 70/2003 on electronic commerce.

Article 1 (Object of the contract)

With these general conditions of sale, Choose Wood sells and the Customer remotely purchases the tangible movable goods indicated and offered for sale in the appropriate catalog on the website www.choosewood.it. The contract is concluded through the internet, by accessing the customer at www.choosewood.it and the creation of a purchase order according to the procedure provided by the site itself.
Before submitting your order, the Customer is required to read these general conditions of sale, and in particular the pre-contractual information provided by Choose Wood, and to accept them by affixing a flag in the indicated box.
In the e-mail communication confirming the order, the Customer will receive the link to download and archive a copy of these general conditions of sale, as required by art. 51, paragraph 1, Legislative Decree 206/2005, amended by Legislative Decree 21/2014.

Article 2 (Pre-contractual information for the consumer)

Pursuant to art. 49 and following of Legislative Decree 206/2005, it is noted that the Customer, before the conclusion of the purchase contract, can view the characteristics of the goods illustrated in the individual product sheets at the time of the Customer’s choice.
Before confirming his order with payment obligation, the Customer is provided with the following pre-contractual information:
– total price of the goods including taxes, with details of shipping costs and any other costs;
– terms of payment;
– the deadline within which Choose Wood undertakes to deliver the goods;
– conditions, terms and procedures for exercising the right of withdrawal pursuant to art. 6 of these general conditions, as well as the withdrawal form referred to in Annex I, Part B, Legislative Decree 21/2014;
– notice that the Customer will have to bear the cost of returning the goods in case of withdrawal;
– existence of the legal guarantee of conformity for the purchased goods;
– after-sales assistance conditions and commercial guarantees provided by Choose Wood.

Article 3 (Conclusion and effectiveness of the contract)

The sales contract is considered concluded with the sending, by Choose Wood to the Customer, of an e-mail communication confirming the order. The e-mail communication contains the Customer’s data and the order number, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent, and the link to be able to print and archive a copy. of these conditions.
The Customer undertakes to check the correctness of the personal data contained in the e-mail communication and to promptly notify Choose Wood of any corrections and / or changes to be made.
Choose Wood undertakes to describe and present the items sold on the site in the best possible way, specifying that, in any case, the representation of the product on the site is to be considered purely indicative and cannot constitute a binding contractual element. The manufacturing of the products is carried out with artisanal and non-industrial processes, therefore any small imperfections, misalignments or out-of-squares constitute a specific characteristic of the product, testifying to the special craftsmanship.
Choose Wood undertakes to deliver the goods within 30 days from the sending by Choose Wood to the Customer of the order confirmation e-mail communication.

Article 4 (Methods of payment)

The customer can make the payment by means of the credit cards indicated on the website www.choosewood.it, or by bank transfer, or by cash on delivery. The communications relating to the payment and the data communicated by the Customer when this is done take place on special protected lines.
In case of payment by credit card, the actual amount of the order will be charged only when the order is complete and ready for shipment. Credit card payment security is guaranteed through the Stripe payment management platform (Stripe, 510 Townsend Street, San Francisco, CA 94103, United States). All data relating to transactions, payment operations and who carries them out, are managed, collected and processed directly and exclusively by Stripe and the banking operators of reference.

Article 5 (Prices)

All sales prices of the products indicated on the website www.choosewood.it are expressed in Euros and include VAT, and the WEEE contribution where applicable.
Shipping costs are not included in the purchase price, but are indicated and calculated at the conclusion of the purchase process before payment is made.
The Client accepts Choose Wood’s right to change its prices at any time without notice. In any case, the purchase will be invoiced on the basis of the price indicated on the site at the time the order is created, which will correspond to the price indicated in the confirmation e-mail sent by Choose Wood to the Customer.
In the event of an IT, manual, technical, or any other kind of error that could lead to an unexpected change in the retail price, such as to make it manifestly excessive or negligible, the purchase order will be canceled and the amount possibly already paid by the customer will be refunded in full within 14 days from the date of cancellation.

Article 6 (Right of withdrawal)

In compliance with current legislation, the Customer has the right to withdraw from the purchase without any penalty and without any obligation to specify the reason, within 14 days from the date of receipt of the product. In the case of multiple purchases made by the Customer with a single order and delivered separately, the 14-day term starts from the date of receipt of the last product.
The Customer who intends to exercise the right of withdrawal must notify Choose Wood by registered letter with return receipt. with any explicit declaration or alternatively by sending the standard withdrawal form (not mandatory) referred to in Annex I, part B, Legislative Decree 21/2014, the text of which is shown below:

In case of exercising the right of withdrawal, the Customer is required to return the goods within 14 days from the date on which he communicated to Choose Wood his will to withdraw from the contract pursuant to art. 57 of Legislative Decree 206/2005. The goods must be returned intact, in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.) and complete with the attached tax documentation, returning it to Choose Wood S.r.l., Via D ‘ Adda 4/4, 20019 Settimo Milanese (MI). Without prejudice to the right to verify compliance with the above, Choose Wood will refund the Customer the amount of the products subject to withdrawal within a maximum period of 14 days.
As for the return of the product subject to withdrawal, Choose Wood ensures its customers the possibility of using a carrier that has an agreement with it. In the event that the Customer decides to use this service, the shipping costs, except for those relating to the telephone booking, will be borne by Choose Wood (art. 56, paragraph 1, Legislative Decree 206/2005). On the other hand, in the event that the customer intends to use another carrier or another means of shipping, all costs will be borne by him (art. 56, paragraph 2, Legislative Decree 206/2005). It is understood that in the event of a product defect, the shipping costs will in any case be borne by Choose Wood. Choose Wood may suspend the refund until the goods are received or until the Customer demonstrates that he has returned the goods to Choose Wood (Article 56, paragraph 3, Legislative Decree 206/2005, amended by Legislative Decree 21/2014).
Choose Wood will reimburse using the same payment method chosen by the Customer during the purchase. In the case of payment made by bank transfer, if the Customer intends to exercise his right of withdrawal, he must provide Choose Wood in the relative communication with the bank details: IBAN, SWIFT and BIC, necessary for Choose Wood to make the reimbursement.

Article 7 (Guarantee of conformity)

In case of receipt of defective products or in any case non-compliant with the orders placed, the Customer has the right to restore the conformity of the product without charge by repairing or replacing the product. The Customer can exercise this right if the defect occurs within two years of delivery of the goods and reports the defect to Choose Wood within two months of its discovery by registered letter with return receipt containing an indication of the defect or non-conformity found. Choose Wood, in the event of a defective or non-compliant product, will arrange, at its own expense, to organize the collection of the product, compatibly with the Customer’s availability.

Article 8 (Delivery methods)

The products will be delivered by express courier to the address indicated by the Customer at the time of the order, no later than 30 days (if delivery must take place in Italy) or 45 days (if delivery must take place in another EU country) starting from ” sending, by Choose Wood to the Customer, of the e-mail communication confirming the order.
For every order placed on the website www.choosewood.it, Choose Wood will issue an invoice for the goods shipped.
The invoice will be made available to the Customer in the forms and terms of the law.

Article 9 (Liability)

Choose Wood assumes no responsibility for any disservices attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disservices of the internet, in the event that it fails to execute the order within the time stipulated in the contract.

Article 10 (Cookies)

The website www.choosewood.it uses ” cookies ”. Cookies are electronic files that record information relating to the Customer’s navigation on the site and that allow Choose Wood to offer a personalized service to its customers.
Choose Wood informs the Customer of the possibility of deactivating the creation of such files, by accessing its Internet configuration menu or by following the specifications contained in the relevant information available here. It is understood that this will prevent the Customer from proceeding with the online purchase.

Article 11 (Integrity of the conditions of sale)

These general conditions of sale are made up of all the clauses that compose them. If one or more of its provisions is considered invalid or declared invalid under the law, regulation or following a decision by a court having jurisdiction, the other provisions will continue to have full force and effect.

Article 12 (Applicable law and competent court)

These general conditions of sale are subject to Italian law, and will be interpreted in accordance with it. Any dispute that does not find an amicable solution will be submitted to the exclusive jurisdiction of the Court of the place of residence or domicile of the Customer, if located in the territory of the State. In any case, in accordance with the European Reg. No. 524/2013, Choose Wood announces that to settle disputes with businesses arising from online purchases of goods and services out of court, consumers can connect to the ODR telematic platform, managed by the European Commission, which can be reached at https: // webgate .ec.europa.eu / odr, and once connected they can choose the body to contact to resolve the dispute and activate the related procedure.
